Do I need my spouse’s consent to divorce?
No — consent makes it faster and cheaper (a joint petition), but after the JPN marriage tribunal stage you can petition on irretrievable breakdown without it. The route planner on this site maps both roads in two minutes.
We just married and it’s already wrong. Can I divorce now?
Section 50 normally requires two years of marriage before a petition, with a narrow exceptional-hardship gateway. Inside two years we usually plan: a deed of separation now, protective steps if needed, petition when eligible.
What’s the difference between custody and care and control?
Custody is authority over major decisions (school, religion, healthcare); care and control is who the child lives with; access is the other parent’s time. Courts often order joint custody with care and control to one parent — understanding the split resolves half of most disputes.
How is our property divided?
Under section 76, the court starts from equality for jointly acquired assets and adjusts for contributions (including homemaking), the children’s needs and debts. The house, EPF contributions during the marriage, savings and businesses are all in the conversation.
I’m frightened of my spouse. What can I do today?

Muslim marriage — do I go to the same court?
No. Muslim family matters go to the Mahkamah Syariah of your state. The routes (talaq, taklik, fasakh, khul’), the vocabulary (hadhanah, nafkah, mutaah, harta sepencarian) and the procedure differ — our syariah team is led by a dual-admitted Peguam Syarie partner.
How much will this cost me, really?

Can we use one lawyer to save money?

Will my case be public?
Family proceedings are heard with far more privacy than most litigation, and nothing about your matter appears anywhere because of us — no testimonials, no case write-ups, no exceptions. Confidentiality is a duty, not a feature.
What if I’m overseas — can you still act for me?
Yes, much of a family matter can run remotely: video consultations, documents by post and commissioner arrangements. Court attendance needs planning, and we will tell you exactly which dates matter.
