Not every estate has to go through the High Court. For many Malaysian families, the estate of a parent or grandparent can be dealt with through the Small Estate Distribution route — pembahagian pusaka kecil — handled by the Estate Distribution Unit at the Land Office rather than a judge. It is designed to be more accessible, and a 2024 change has made it available to far more families.
What changed in 2024
The Small Estates (Distribution) Act 1955 was amended, and the changes came into force on 15 July 2024. Two matter most:
- The value threshold was raised to RM5 million (up from RM2.5 million).
- The old requirement that the estate must include immovable property (land) was removed — so an estate can now qualify as a small estate even if it is made up entirely of movable assets.
The effect is that many more estates now qualify for this simpler, cheaper route than did a few years ago.
When the small-estate route applies
Broadly, it applies where the deceased died intestate (without a will) and the estate does not exceed RM5 million. If there is a valid will, the estate generally goes through probate instead. If the estate exceeds the threshold, it goes to the High Court for letters of administration.
How the process works
An application (Form A) is filed with the Estate Distribution Unit, supported by the death certificate, details of the assets and a list of the beneficiaries. The office holds an enquiry — a hearing where the beneficiaries attend, the shares are confirmed, and a distribution order is made. Because there is no administration bond and no court litigation, it is usually less expensive than a High Court administration, though it still takes time and careful preparation.
Where families get stuck
The route is simpler, but not effortless. Common problems are missing or incomplete asset information, beneficiaries who cannot be located, disputes between family members at the enquiry, and property that turns out to be jointly owned or charged to a bank. Getting the paperwork right the first time saves months.
