A valid will is the difference between deciding for your family and letting a statute decide for them.

A will is the simplest, cheapest thing most Malaysians never get around to — and the one document that decides whether the people you love inherit smoothly or spend a year and a small fortune sorting out what you left behind. Without one, the Distribution Act 1958 (for non-Muslims) or faraid (for Muslims) decides who gets what, in fixed shares that rarely match what you would have chosen.

We draft wills that are clear, correctly executed and built to survive scrutiny. That means naming executors who are willing and able to act, appointing guardians for minor children, and — where it matters — pairing the will with a trust so that money does not fall into the hands of an eighteen-year-old or a beneficiary who cannot manage it.

You receive a plain-language draft with our notes on anything that needs a decision or a trust.

We supervise signing and witnessing, and store the original safely if you wish. A copy goes to you and your executor.

Questions about wills & will drafting

Does getting married cancel my old will?

For non-Muslims under the Wills Act 1959, yes — a will is revoked by your subsequent marriage unless it was expressly made in contemplation of that marriage. This catches many people out, and is a good reason to review a will after any change in marital status.

Can my spouse or child be a witness?

They can witness the signing, but a beneficiary (or a beneficiary’s spouse) who acts as a witness generally loses their gift under the will. We make sure your witnesses are independent so no gift is put at risk.

Is a will I downloaded online valid in Malaysia?

It may be technically valid if signed and witnessed correctly, but templates routinely miss executors, guardianship, residuary clauses and trust provisions — and small drafting errors can make a gift fail entirely. The cost of fixing a defective will after death is far higher than drafting it properly now.

What happens to my EPF, insurance and jointly-owned property?

These often pass outside your will — EPF and insurance by nomination, joint property by survivorship. Part of our job is to check that your nominations and your will point the same way, so nothing is accidentally left out or double-counted.
