What we collect

Names, contact details, and the information you give us about a property or a search. For sellers, landlords, buyers and tenants who proceed, that extends to identification documents, proof of address and proof of funds, because we are required to collect them.

Why we are allowed to

  • Contract — to market your property, arrange viewings, progress a sale or run a tenancy.
  • Legal obligation — anti-money-laundering checks under the Money Laundering Regulations 2017, Right to Rent checks, and HMRC record-keeping.
  • Legitimate interests — telling registered buyers about properties that match what they asked for, and keeping records of what we advised.
  • Consent — marketing emails, which you can stop at any time without affecting anything else.

Who sees it

Our staff; the other side’s agent and solicitors where a transaction requires it; referencing and identity-check providers; the property portals for listing information only; our accountants and auditors. We do not sell data and we do not pass your details to mortgage brokers or conveyancers for a referral fee without telling you first and getting your agreement.

How long we keep it

Anti-money-laundering records for five years after the transaction, as required. Tenancy and client-account records for six years. Enquiries that go nowhere are deleted after twenty-four months.

Your rights

You can ask for a copy of what we hold, ask us to correct it, ask us to delete it where we are not required to keep it, object to marketing, and complain to the ICO at ico.org.uk. Write to Tom Rook at the Stamford office or email hello@wellandandrook.co.uk; we answer within one month.
